Terms and Conditions

These Terms and Conditions ("Terms") govern the agreement ("Agreement") between You (the purchaser of the services and/or products offered by Path Insight, LLC) and Path Insight, LLC, DBA Igniting Peak Performance ("Company," "we," "us," or "our"). By purchasing or using our services, You agree to be bound by these Terms.

1. Payment Terms
You authorize Path Insight, LLC to process the payment method You provide for the amount specified at the time of purchase. All payments are final, and no refunds will be issued unless expressly stated otherwise. Your purchase includes only the services or products specified at the time of checkout. We reserve the right to suspend or terminate access to services for non-payment or breach of these Terms.

2. No Guarantees

You acknowledge that Path Insight, LLC has made no guarantees regarding specific results or outcomes from using our services or products. Any examples of success or testimonials are illustrative and not a promise of similar results.

3. Term and Termination

This Agreement shall remain in effect from the date of purchase. Path Insight, LLC reserves the right to terminate this Agreement and revoke access to services or products at any time, for any reason, including but not limited to breach of these Terms.

4. Intellectual Property

Path Insight, LLC retains all rights, title, and interest in its intellectual property, including but not limited to trademarks, copyrights, proprietary materials, and methodologies. You agree not to share, distribute, or reproduce any materials provided by us without express written permission. All materials are provided for personal use only and may not be used for commercial purposes.

5. Contact Authorization

By providing your contact information, You consent to receive communications from Path Insight, LLC, including emails, calls, and text messages regarding your account, services, or other offerings. You may opt out of marketing communications at any time.

6. Indemnification

You agree to indemnify and hold harmless Path Insight, LLC, its officers, employees, contractors, and agents from any claims, liabilities, damages, or expenses arising from your use of our services or breach of this Agreement.

7. Limitation of Liability

To the maximum extent permitted by law, Path Insight, LLC’s liability to You for any claims arising under this Agreement is limited to the amount You paid for the services in the twelve (12) months preceding the claim. We are not liable for any indirect, incidental, or consequential damages.

8. Force Majeure

We are not responsible for delays or failures caused by events beyond our control, including but not limited to acts of God, natural disasters, government actions, labor strikes, or technological failures.

9. Representations and Warranties

You represent that You are entering into this Agreement in good faith and that all information You provide is accurate and complete. You agree to notify us promptly of any changes or issues that may affect your ability to fulfill your obligations under this Agreement.

10. Modifications

Path Insight, LLC reserves the right to modify, discontinue, or replace any service or product at any time without prior notice. We may update these Terms from time to time. Continued use of our services constitutes acceptance of the updated Terms.

11. No Agency

Nothing in this Agreement creates a partnership, joint venture, or agency relationship between You and Path Insight, LLC. You agree not to represent yourself as an agent or employee of the Company.

12. Arbitration

Any disputes arising under these Terms shall be resolved exclusively through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will take place in Gwinnett County, Georgia. Each party shall bear its own legal fees and costs. Claims must be filed within one (1) year of the incident giving rise to the claim.

13. Waiver of Class Action

You agree to resolve disputes on an individual basis and waive the right to participate in any class action lawsuit or proceeding.

14. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of laws principles.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

16. Assignment

You may not assign this Agreement without prior written consent from Path Insight, LLC. We may assign this Agreement at our sole discretion.

17. Entire Agreement

These Terms constitute the entire agreement between You and Path Insight, LLC regarding your purchase and use of our services. Any prior agreements or understandings are superseded by these Terms.
